Bosnia-Herzegovina: Prosecution against the former officer with war crimes




Prosecutor in charge of investigations of war crimes in Bosnia and Herzegovina indicted a Muslim, former military officer, it did not prevent the commission of crimes by foreign Islamic fighters with victims of Bosnian Serb soldiers during the civil war in the Balkan country (1992-1995 ).

The 63chronos retired Shakib Machmoulin arrested December 8 and charged to the charge that his actions while serving in the 3rd Corps contrary to international humanitarian law and the Geneva Conventions.

According to the prosecutor, the offenses allegedly committed dating the period July-October 1995, while the war was heading towards the end, as the 3rd Corps and a contingent of foreign fighters, who was known as El Mujahid, was unleashed attacks in the central part of Bosnia, according to the Athens agency.

Many Islamist fighters, or mujahedin went to Bosnia by States of North Africa and the Middle East to fight alongside their co-religionists against the Orthodox Serbs and Catholic Croats during the war in Bosnia, which claimed the lives of about 100,000 people.

The detachment El Mujahid officially was under the command of the Bosnian army during the war - but in practice acted autonomously.

According to data of the prosecutor members of the El Mujahid contingent kidnapped and murdered 50 prisoners Bosnian Serb soldiers who had surrendered to other units of the 3rd Army Corps.

"Some prisoners were executed in ritual beheadings and their heads were displayed as an example to others," he said in a statement the prosecutor. According to the same source, members of the El Mujahid contingent used extremely cruel methods of torture against prisoners.

"They cut the ears, kicked them, tied their hands and beaten," according to the statement of the prosecutor. "Some victims were hung with ropes to the neck in awkward postures, which meant that he drowned if they made any move, and left them there for hours," specified in the notice.

It has become exhumation of the remains of ten victims while it remains unknown where are the bodies of the others in accordance with the same Bosnian prosecutor.

The Machmoulin not prevented neither disciplinary sanctions for the crimes of members of the contingent El Mujahid although it was aware of how committed, according to the prosecutor, who stated that she would be called 70 witnesses and presented 900 items during trial.

In 2008 the International Criminal Tribunal for the Former Yugoslavia had imposed a prison sentence of three years in the former head of the armed forces of Bosnia because it had authorized torture of Bosnian Serb soldiers by Islamic foreign fighters. Then Machmoulin had tried talking to local media not disclaim all responsibility and had argued that it had no control over the fighters contingent El Mujahid.

The investigation against Shakib Machmoulin started by the International Criminal Tribunal for the former Yugoslavia of the United Nations, which is based in The Hague, but which subsequently forwarded the files for less important cases in Bosnia justice.
